Abbeville County, S.C. Archived Abbeville County Probate Court Wills ~1782 to ~2006 (4) |
|
Effective: 25 Feb 2018
The motivation behind this project was to simply preserve Abbeville's archived Probate Wills in a "digital format" -- for fast searching.
On 19-Jul-2013 this project was started by Paul M. Kankula, in partnership with the Anderson County Genealogical Society.
Project Volunteers: Fred & Sue Brewer (ledger imaging). Carolyn Duncan, Barbara Harris, Shirley Phillips, Vicki Cox & Jo Simpson (Name Index typing).
Some ledgers contained Wills that were not listed in the ledger's Handwritten Name Index.
Trying to provide an accurate Name Index that referenced a specific ledger page number, proved to be too difficult.
Every ledger with Handwritten Name Indexes, contained some names that were very difficult to read. ( If you don't find who you are looking for, try referencing the Church of LDS General Entry Indexes. )
(1) = The following ledger reference numbers are basically for our own datafile linking & reference purposes.
(2) = In ~1958, the Church of LDS microfilmed many existing WPA documents and Wills.
(3) = Afterwards the SC Archives & History Department made the WPA transcribed ledgers available on-line.
(4) = Then in ~2006, the Abbeville Probate Court started scanning their Wills directly into their county computer system.
(5) = If you wish a hard-copy of a particular Will, write the Probate Court naming the decedent and the approximate date-of-death. You will receive a cost estimate in reply to your query, IF, you enclose a Letter Size Self Addressed & Stamped Envelope. The Court Charges $0.50 cents per page or side for copies, $1.50 handling & postage. (+$5.00 adder fee for out-of-state requests.)

COUNTY HISTORY:
The Ninety-Six District was created as an original Judicial District in 1769. It superceded the old County Court System that had been in place since the 1600's. In 1785 the Ninety-Six District was divided into six counties: ABBEVILLE, Edgefield, Laurens, Newberry, Spartanburg & Union. These counties co-existed within the Ninety-Six District and were non-functional (no government). They only served only as geographical divisions until later on. In 1798, all Judicial Districts were abolished and their county divisions became Districts. So at that time, Ninety Six was abolished and ABBEVILLE, Edgefield, Laurens & Newberry became Districts. The Ninety-Six District bordered Georgia on its Western Boundary and was the ancestral home on many early Georgia settlers. Parts of ABBEVILLE later went to form Greenwood (1897) & McCormick (1916) counties.
1670, the first permanent English settlement was made at Albemarle Point (Charles Town).
1713-1719, the SC region separated from NC and became a royal colony. Records were kept in Charleston.
1769, Nine original judicial districts were established, but records were still kept in Charleston until 1780.
1788, SC became a state. The state government was moved from Charleston to Columbia in 1790, although some functions remained at Charleston until after the Civil War.
1860, SC was the first state to secede from the Union.
1868, SC was readmitted to the Union. Districts were now called counties.
1785, Abbeville County & County Court established.
1787-1799, called Abbeville County Court.
1800-1868, called Abbeville Court-of-Ordinary.
1869-YTD, called Abbeville Probate Court.
SC Statute standardized the record keeping practice in the Court-of-Ordinary, requiring the ordinary to record Wills in a separate series of Will Books. Previously, Wills together with other documents pertaining to estates, were transcribed into a series of Estate Record Books. In some counties, the ordinaries transcribed earlier Wills from the Estate Record Books into Will Books. The original wills were always filed in the Estate Papers series. Will Books have been maintained by the Probate Court since the Court-of-Ordinary, was abolished in 1868.
